1. Purpose of OptionWise

OptionWise is a marketing, informational, and referral website designed to connect consumers interested in health, wellness, weight management, telehealth, and related products or services with third-party providers (“Referral Partners”).

OptionWise does not itself provide medical care, diagnose medical conditions, prescribe or dispense medication, or make medical treatment decisions.

Through the Site, you may be connected or redirected to an independent Referral Partner that provides products or services that may be of interest to you.

OptionWise may provide marketing, referral, lead-generation, technology, communications, consent-verification, or administrative services in connection with these Referral Partners.

2. Referral Partners

Referral Partners are independent third parties.

Any healthcare services, medical consultations, treatment recommendations, prescriptions, medications, eligibility determinations, pricing, subscriptions, payments, fulfillment, or patient-provider relationships are provided or administered by the applicable Referral Partner and/or its affiliated licensed healthcare professionals.

Those services may be subject to separate terms, privacy policies, medical consents, notices, eligibility requirements, and other policies provided by the applicable Referral Partner.

When you leave OptionWise.us and visit a website or service operated by a Referral Partner, your use of that website or service is governed by the terms and policies of that Referral Partner.

OptionWise does not control medical or clinical decisions made by independent healthcare providers.

3. No Medical Advice

Information provided through OptionWise is for general informational and marketing purposes only.

Nothing on the Site is intended to constitute medical advice, diagnosis, treatment, or a substitute for consultation with a qualified healthcare professional.

Nothing on OptionWise.us creates a physician-patient relationship between you and OptionWise.

Prescription medications, when offered by a Referral Partner, require evaluation and approval by an appropriately licensed healthcare professional. Not every individual will qualify for treatment.

Treatment options, eligibility, pricing, availability, and prescribing decisions may vary based on factors including medical history, provider judgment, location, and applicable law.

4. Eligibility

You must be at least 18 years old to use the Site or submit information through OptionWise.

By using the Site, you represent that the information you provide is accurate and that you are authorized to provide any telephone number, email address, or other contact information submitted through or associated with your use of the Site.

5. Marketing Communications and SMS Consent

OptionWise may provide opportunities for you to consent to receive marketing or promotional communications regarding products or services offered by OptionWise or an identified Referral Partner.

Where you affirmatively provide consent, you authorize the sender or sender(s) specifically identified in the consent disclosure presented to you to deliver or cause to be delivered the communications described in that disclosure.

Communications may include SMS or MMS text messages and telephone calls and may be delivered using automated technology and/or an artificial or prerecorded voice where permitted by applicable law and consistent with the consent you provide.

OptionWise may provide communications, marketing, technology, or messaging services on behalf of an identified Referral Partner.

Your consent applies only to the sender, subject matter, and communications described in the consent disclosure presented to you at the time you opt in.

Consent to marketing communications is not a condition of purchasing any product or service or receiving healthcare services.

Message frequency may vary. Message and data rates may apply.

Wireless carriers are not responsible for delayed or undelivered messages.

6. Opting Out of Text Messages

You may revoke your consent to receive marketing text messages at any time.

You may reply STOP to a text message to unsubscribe from that messaging program.

Other clear and reasonable requests to discontinue messaging may also be honored in accordance with applicable requirements.

After submitting an opt-out request, you may receive a non-promotional confirmation message acknowledging your request.

You will not receive additional marketing messages from the applicable messaging program unless you subsequently provide consent again.

7. Help With Text Messages

You may reply HELP to a text message for information or assistance with the applicable messaging program.

Additional assistance or contact options may also be made available through OptionWise.us or through the applicable Referral Partner.

8. Electronic Consent and Records

When you check a consent box, click a button indicating agreement, submit a form, or otherwise electronically indicate your consent or agreement, your electronic action may constitute an electronic signature and may be used as evidence of your agreement.

OptionWise may use third-party consent-verification and recordkeeping technology, including TrustedForm or similar services, to document the circumstances surrounding a consent event.

Records may include information such as:

• Date and time of the consent event;
• Telephone number associated with the consent;
• The webpage or URL on which consent was provided;
• The disclosure and consent language presented;
• IP address;
• Device and browser information;
• Referral or campaign information;

They may be provided to applicable Referral Partners, communications providers, technology providers, compliance vendors, service providers, regulators, courts, or other parties with a legitimate need to verify or document the consent event.

9. Privacy and Personal Information

Your use of OptionWise is also governed by our Privacy Policy, which describes how information collected through the Site may be collected, used, disclosed, and retained.

When you request to be connected with a Referral Partner, information reasonably necessary to fulfill your request may be provided to that Referral Partner and to service providers assisting with the referral.

Mobile telephone information and SMS opt-in consent information will not be sold or provided to unrelated third parties or affiliates for their own independent marketing or promotional purposes.

11. Healthcare Services and Treatment Eligibility

OptionWise does not guarantee that you will qualify for any particular medication, treatment, healthcare service, promotion, product, or price.

Where medical services or prescription products are offered, treatment and prescribing decisions are made solely by appropriately licensed healthcare professionals associated with the applicable provider.

Availability of healthcare services and medications may vary based on location, provider availability, clinical eligibility, medical history, and applicable laws and regulations.

12. Advertising and Informational Content

OptionWise strives to present information accurately. However, products, services, offers, eligibility requirements, availability, pricing, promotional terms, and other information may change.

Information concerning a third-party product or service is subject to confirmation by the applicable Referral Partner.

Nothing on OptionWise constitutes a guarantee of:

• Medical outcomes;
• Weight loss;
• Treatment approval;
• Prescription eligibility;
• Product availability;
• Financial savings;
• Specific pricing; or
• Any particular result.

13. Intellectual Property

Unless otherwise indicated, the OptionWise name, website design, text, graphics, logos, and other content created for the Site are owned by or licensed to OptionWise and may be protected by applicable intellectual-property laws.

You may use the Site for personal, noncommercial purposes only.

You may not copy, reproduce, distribute, modify, republish, scrape, commercially exploit, or otherwise misuse Site content without authorization.

Third-party names, trademarks, logos, product names, and other intellectual property remain the property of their respective owners.

To the fullest extent permitted by applicable law, OptionWise and its owners, employees, contractors, vendors, service providers, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of the Site.

OptionWise is not responsible for medical decisions, medical services, treatment, prescriptions, medication, fulfillment, billing, products, or other services independently provided by a Referral Partner or other third party.

Nothing in these Terms limits liability that cannot legally be limited or excluded.

18. Changes to These Terms

We may update these Terms periodically to reflect changes to our services, business practices, technology, or applicable requirements.

When changes are made, we may update the Effective Date displayed at the top of this page.

Your continued use of the Site after revised Terms become effective constitutes acceptance of those revised Terms to the extent permitted by applicable law.

19. Applicable Law

These Terms are subject to applicable federal, state, and local laws and regulations.

Nothing in these Terms is intended to waive or limit rights that cannot lawfully be waived or limited.
